The most important information about CBAM. Who, what and when is a subject to the CBAM regulation and how are we able to assist you with being compliant?

What exactly is CBAM?

Carbon Border Adjustment Mechanism (CBAM) was established by Regulation (EU) 2023/956 of the European Parliament and of the Council of 10 May 2023.

It is the EU’s “carbon border tax” that equalises the carbon price paid on imported carbon-intensive goods with the price faced by EU producers under the Emissions Trading System (ETS).

Who is subject to CBAM regulation?

Any importer or indirect customs representative that clears CBAM-listed goods into the EU customs territory from any non-EU country. From 2026 you must hold “authorised CBAM declarant” status to keep importing.

Which goods are currently in scope?

Cement, iron & steel (including some downstream products), aluminium, fertilisers, electricity and hydrogen. Selected precursors in these supply-chains are also covered.

What are the key deadlines?

Transitional phase: 1 Oct 2023 – 31 Dec 2025 – quarterly CBAM reports only (first report due 31 Jan 2024).

Definitive regime: starts 1 Jan 2026 – buy CBAM certificates, file annual declaration by 31 May each year, surrender certificates in line with verified emissions.

What happens if I miss a report or under-declare?

2023-25: Administrative fine of €10 – €50 per tonne CO₂-e not (or wrongly) reported; index-linked and imposed by the Member State customs authority.

From 2026: failure to surrender enough certificates triggers the EU-ETS equivalent penalty – €100 per tonne, plus the obligation to make up the shortfall.
